Terms of Service

1.Acceptance of Terms
By accessing or using Talebuddy("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Kadima Technology("we", "us", "our").
We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms with an updated date and, where appropriate, by email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
2.Description of Service
Talebuddy is an AI-assisted writing tool for fiction and narrative game development. It provides features including but not limited to: a rich-text editor, entity tracking, AI writing transforms (expand, compress, rephrase), document summarisation, and integration with third-party tools such as Obsidian.
The Service may run AI models locally on your device or via cloud AI providers (including Google Gemini, Anthropic Claude, DeepSeek, and others), depending on your plan and configuration. The browser uses Gemma 2 for local inference. Our desktop and mobile apps use Gemma 3 and Gemma 4 for on-device inference.
3.Accounts & Eligibility
- You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You must provide accurate information when creating an account. Impersonation or false registration is prohibited.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4.Subscriptions & Payments
Certain features of the Service require a paid subscription. By subscribing you authorise us to charge your chosen payment method on a recurring basis (monthly or annually as selected). All fees are stated in USD unless otherwise indicated and are exclusive of applicable taxes.
- Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial-period refunds are issued unless required by applicable law.
- Refunds. All sales are final except where required by law. If you believe you were charged in error, contact us at legal@kadima-tech.com within 14 days of the charge.
- Price changes. We will give at least 30 days' notice before increasing subscription prices. Continued use after the effective date constitutes acceptance.
5.AI Usage & Third-Party Model Terms
The Service integrates AI models from third-party providers. Your use of AI features is subject to both these Terms and the applicable third-party terms listed below.
5.1Google Gemma 2 and Gemma 3
The browser's Gemma 2 model and the desktop and mobile apps' Gemma 3 model are subject to the Gemma Terms of Use. By using either model through the Service, you agree to those terms. The Gemma use restrictions, including the Gemma Prohibited Use Policy, are incorporated into and enforceable under these Terms.
A copy of the Gemma Terms of Use is available from Google at the link above. For non-hosted distributions of Gemma 2 or Gemma 3, the native app bundle also includes the required notice that identifies the Gemma Terms of Use.
5.2Google Gemma 4
The desktop and mobile apps' Gemma 4 model, and the Gemma 4 model behind the free writing tools, are provided under the Apache License 2.0. The Gemma Terms of Use and Gemma Prohibited Use Policy do not govern Gemma 4. The native app bundle includes the required Apache License 2.0 notice and license materials for that model.
5.3Model derivatives and redistribution
If we distribute Gemma 2, Gemma 3, or a modification or model derivative of either (including through fine-tuning or distillation), we will retain the applicable Gemma use restrictions as enforceable terms, give downstream users the required notice, and provide the Gemma Terms of Use. Gemma 4 derivatives and distributions are governed by the Apache License 2.0 and any notices supplied with the model.
5.4Cloud AI Providers
When you use cloud AI features your prompts and content may be processed by Google (Gemini), Anthropic (Claude), DeepSeek, or Qwen, subject to their respective terms and privacy policies. You are responsible for ensuring that content you submit to cloud AI services complies with those providers' terms.
5.5Outputs
AI-generated outputs are provided as-is without warranty of accuracy, completeness, or fitness for any purpose. Kadima Technology does not claim ownership of outputs generated through your use of the Service. You are solely responsible for how you use AI outputs, including verifying their accuracy and ensuring their use complies with applicable law and these Terms.
5.6Provider restrictions
Google expressly reserves the right to restrict or suspend access to Gemma if they reasonably believe you are violating the Gemma Terms of Use. Such a restriction may affect your ability to use local AI features of the Service and does not entitle you to a refund of fees paid.
6.Prohibited Uses
The restrictions in Sections 6.1 through 6.4 are the Gemma Prohibited Use Policy, incorporated as enforceable terms for Gemma 2, Gemma 3, and their model derivatives. They apply whether those models run in the browser, desktop app, or mobile app. Section 6.5 applies to all use of the Service. This list is not exhaustive; we reserve the right to determine in our sole discretion whether conduct violates these Terms.
6.1Rights violations
- Generating content that infringes, misappropriates, or otherwise violates another person's or entity's rights, including rights in copyrighted content.
6.2Dangerous, illegal, or malicious activity
- Violating applicable law; facilitating crimes; or promoting child sexual abuse or exploitation, violent extremism, terrorism, or illegal goods, services, or substances.
- Engaging in the illegal or unlicensed practice of a profession, including legal, medical, accounting, or financial practice.
- Generating spam, scams, phishing, malware, or content for other deceptive or fraudulent activity; or abusing, harming, interfering with, or disrupting a service.
- Attempting to override or circumvent safety filters, or intentionally causing Gemma or a Gemma derivative to contravene these restrictions.
- Promoting hatred, harassment, bullying, violence, or self-harm; generating personally identifying information for harmful distribution; tracking people without consent; or creating content with unfair or adverse impacts based on sensitive or protected characteristics.
- Gathering, processing, or inferring sensitive personal or private information about a person without all rights, authorisations, and consents required by law.
6.3Deception, misinformation, and high-impact decisions
- Misrepresenting AI-generated content as human-created or original in order to deceive, or impersonating a living or deceased individual without clear disclosure in order to deceive.
- Making misleading claims of expertise or capability, particularly in health, finance, government, or legal contexts.
- Making automated decisions that affect a person's material rights or well-being, including decisions in finance, legal services, employment, healthcare, housing, insurance, or social welfare.
- Generating defamatory content or engaging in unauthorised or unlicensed professional practice.
6.4Sexually explicit content
- Generating sexually explicit content for pornography or sexual gratification, including sexual chatbots. This does not prohibit content created for scientific, educational, documentary, or artistic purposes.
6.5Platform integrity
- Attempting to reverse-engineer, extract weights from, or derive proprietary model architectures from Gemma or any other AI model accessed through the Service.
- Circumventing access controls, rate limits, or usage quotas.
- Using the Service to train competing AI models unless expressly permitted in writing by us.
- Automated scraping or bulk data extraction from the Service.
Violation of any prohibition in this Section may result in immediate suspension or termination of your account and, where appropriate, referral to law enforcement.
7.Your Content
You retain ownership of the content you create using the Service ("Your Content"). By using the Service you grant us a limited, non-exclusive, royalty-free licence to host, store, transmit, and display Your Content solely to provide and improve the Service.
You are solely responsible for Your Content. You represent and warrant that:
- You own or have the necessary rights to Your Content.
- Your Content does not violate these Terms, applicable law, or the rights of any third party.
- Your Content does not contain material that is defamatory, obscene, or unlawful.
We do not actively monitor Your Content but reserve the right to remove content that violates these Terms or applicable law.
8.Intellectual Property
The Service, including its design, code, branding, and documentation, is owned byKadima Technology or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand names without prior written permission.
Gemma 2 and Gemma 3 are licensed under the Gemma Terms of Use; Gemma 4 is licensed under the Apache License 2.0. You acknowledge that Google retains all intellectual property rights in Gemma and its derivatives.
9.Privacy
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
10.Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing all AI outputs before relying on or publishing them.
11.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KADIMA TECHNOLOGY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €100.
12.Indemnification
You agree to indemnify, defend, and hold harmless Kadima Technology and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.
13.Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or for any other legitimate business reason. You may terminate your account at any time by contacting us at legal@kadima-tech.com.
Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination (including Sections 6, 7, 8, 10, 11, 12, and 14) will continue to apply.
14.Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the Netherlands, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
15.General
- Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the remaining provisions will continue in full force and effect.
- No waiver. Our failure to enforce any provision does not constitute a waiver of our right to do so in the future.
- Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign ours freely.
